5 Healthy Towns Wellness Centers (“Wellness Centers,” “Company”, “we”, “us”, “our”) is committed to your privacy. This Privacy Policy (the “Policy”) describes the types of information we may collect from you when you visit our website www.chelseawellness.org, www.dexterwellness.org, www.stockbridgewellness.org (the “Website”), our mobile application [To be Released in 2022] (the “Mobile Application”), or that you may provide when you interact, register with, access, or use any Wellness Centers services on the Website or our Mobile Application (collectively with the Website, the “Services”), and our practices for using, maintaining, protecting, and disclosing that information. There may be additional privacy policies or practices that apply from the client which owns the facility.

This Policy applies to information we collect for us and on behalf of our clients:

• On this Website or Mobile Application;
• In email, text, and other electronic communications between you and the Wellness Centers and between you and a client;
• Through the Website or Mobile Application and other electronic communications sent through or in connection with the Website or Mobile Application and Services; and
• When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.

This Policy does NOT apply to information you provide to or that is collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website or Mobile Application.

By accessing or using this Website or Mobile Application, you agree to this Policy. This Policy may change from time to time (see “Changes to Our Privacy Policy”). Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Website and Mobile Application, including:

• To convey information about our Services to our clients;

This website uses an accessibility service (UserWay) to provide enhanced accessibility features. This service loads functional scripts and assets to enable accessibility controls and may process limited technical information such as IP address, browser type, and page URL solely to deliver accessibility functionality.

This service is not used for analytics, advertising, marketing, profiling, or tracking user behavior across websites.

Our websites may load fonts and icon libraries from third-party content delivery networks (CDNs), such as Google Fonts, Adobe Fonts (Typekit), and Font Awesome, to ensure consistent visual presentation. When these resources are loaded, the provider may receive limited technical information such as IP address and browser details as part of standard content delivery.

These font and icon services are used solely for visual presentation purposes and are not used for analytics, advertising, or user profiling.

Disclosure of Your Information

We may disclose aggregated information about our users and information that does not identify any individual without restriction. We may disclose Personal Information that we collect, or you provide as described in this Privacy Policy:

• With affiliates or subsidiaries, business partners, service providers, or other third parties we use to provide you with the Services and its contents and functions;
• Wellness Centers may share information you provide with our business partners and affiliates as part of combined statistical data that does not include individually identifiable data about any user. Wellness Centers is part of a group of fitness and wellness centers that are managed collectively, Wellness Centers reserves the right to share any aggregated data, statistics, and analysis with third parties, however, this aggregated information will not contain any users’ identifiable personal information;
• To third parties to market their products or services to you if you have not opted out of these disclosures;
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our users is among the assets transferred;
• To fulfill the purpose for which you provide it;
• For any other purpose disclosed by us when you provide the information; and
• With your consent.

We may also disclose your Personal Information:

Your Privacy Rights and Choices

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies or alert you when cookies are being sent. Note that some parts of the Services may then be inaccessible or not function properly if you do so.

We may disclose and have disclosed in the past 12 months Personal Information to third parties for business purposes as set forth in the chart above and in this Privacy Policy. In the preceding twelve (12) months, we have not sold Personal Information.

The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

1. Access to Specific Information and Data Portability Rights.

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see “Exercising Your Rights” section), we will disclose to you:

• The categories of Personal Information we collected about you;
• The categories of sources for the Personal Information we collected about you;
• Our business or commercial purpose for collecting or selling that Personal Information;
• The categories of third parties with whom we share that Personal Information;
• The specific pieces of Personal Information we collected about you (also called a data portability request;
• If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:
• Sales, identifying the Personal Information categories that each category of recipient purchased; and
• Disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

2. Deletion Request Rights.

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see “Exercising Your Rights” section), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. Please be aware that under certain circumstances, the CCPA may limit your exercise of these rights.

3. Exercising Your Rights.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Please be aware that under certain circumstances, the CCPA may limit your exercise of these rights.

4. Response Timing and Format.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

• Deny you goods or services;
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
• Provide you a different level or quality of goods or services; or
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Changes to Our Privacy Policy
